General Information for Requesting Appointment of a Special Magistrate for Teacher Empowerment

A classroom teacher may request the appointment of a Special Magistrate if the teacher was directed by his or her school or school district to violate general law or State Board of Education rule. The law pertaining to special magistrate requests for teacher empowerment is found in section 1015.06, Florida Statutes. The process for a classroom teacher to request a special magistrate is found in Rule 6A-1.094127, Florida Administrative Code (F.A.C.).

Teachers seeking the appointment of a Special Magistrate must use the form “Request for Appointment of a Special Magistrate.” Teachers can contact the Florida Department of Education staff to assist with questions and answers throughout the process.
